General Terms of the Rental Agreement

University Student Apartment's Rental Agreement is a month-to-month contract. Residents must pay rent monthly, in advance, on or before the first day of the month. Their account is considered delinquent if they have not paid the rent in full by the close of business (4:30 p.m.) on the first day of the month. Furthermore, if a resident's account is not paid in full by the close of business on the 15th calendar day of each month, Student Apartments will assess a $15.00 late fee, which the resident agrees to pay.

If resident is an employee of the University of Utah and fails to pay their account in full, within 30 days of the due date, the employee agrees that University Student Apartments may have the amount due withheld from their paycheck. The amount due may include, but is not limited to, past due rent, late fees, court costs, damages, or childcare fees.

Student Apartments has the right to increase rental rates during the term of the Rental Agreement, with 30 days written notice.

The Rental Agreement may be canceled by Student Apartments, with advance notice in writing, for circumstances including, but not limited to the following:

  1. The resident fails to maintain Student Apartments' eligibility requirements;
  2. The resident fails to pay rent or other charges owed when they are due (Student Apartments is not required to give advance notice in cases of delinquent rent);
  3. The resident, or a member of their family, or guest repeatedly disturbs other residents and/or commits repeated or multiple violations of the University of Utah or Student Apartments' policies;
  4. The resident, or a member of their family, or guest engages in any criminal activity.
  5. The resident, or a member of their family, or guest fail to abide by and follow the rules and regulations of the Rental Agreement and Resident Handbook or to abide by other pertinent University of Utah and Student Apartments regulations or policies;

The resident must submit written notice to Student Apartments at least 30 days before their intended vacate date. If they vacate the apartment in less than 30 days, they accept liability to pay rent for the remainder of the 30-day period. The resident's right of entry to the apartment ends when they turn in the keys; however, they will still be liable for rent for the full 30-day period.

Apartment Transfers

Residents may transfer from one apartment to another subject to the following conditions:

  1. They must submit a transfer application and pay a non-refundable $100.00 transfer fee ($25.00 is due when submitting the transfer application and $75.00 at the time of transfer).
  2. The transfer request will be subject to the waiting list and occupancy guidelines outlined below,
  3. The resident must have lived here for at least six months and not transferred within the past year.
  4. The resident must have received no more than one late fee during the previous six months.
  5. The resident must meet the Student Apartments' eligibility requirements. And not currently be on housing eligibility probation.

When a resident accepts a transfer assignment, their name will be removed from all waiting lists. Residents are allowed three (3) days to transfer at no additional cost. The resident agrees to pay a penalty of up to $100.00 per day for any additional days used to transfer.

Smoking Restrictions

Smoking is not allowed in any building managed by University Student Apartments. This policy includes the West Village (South and North Courts), East Village, Medical Plaza towers and townhouses, and Fort Douglas houses and townhouses.

Smoking is not allowed in court common areas. Court common areas include balconies, stairwells, hallways, laundry rooms, community centers, garden plots, playground and picnic tables, and all areas within the perimeter of the court.

The Utah Clean Air Act prohibits smoking in public areas and within twenty-five (25) feet of any building entrance, window, or air intake area. 

All smoking materials should be disposed of properly.

Student Apartments investigates all smoking complaints. Residents are responsible for ensuring that their visitors and guests abide by this policy.

Residents will be subject to Section 2.4 for violation of this policy. Residents will also be responsible for all cleaning and damages incurred to remove the smoke smell from their apartment or other apartments their smoking impacts.

No Pets and Animals

No pets or animals of any kind may be kept, fed or sheltered on or about Student Apartments' property and facilities. This also applies to the feeding of stray animals. The only exceptions to this policy are fish and service animals. This policy is enforced by assessing a $30.00 fee for the first violation. Residents found violating this policy will be given notice to remove the pet/animal and provide evidence of removal within a specified time, or vacate the premises in accordance with the Rental Agreement. Student Apartments reserves the right to inspect the premises without notice to verify compliance. Second violations may result in the fee escalating to $50.00 and cancellation of the Rental Agreement.

Should a tenant wish to have a service or companion animal, s/he needs to make a request for disability accommodation to the University’s Office of Equal Opportunity and Affirmative Action (OEO/AA), located at 135 Park Building (581-8365). It is the responsibility of the tenant to ensure that s/he makes a request for disability accommodation for a service/companion animal to the OEO/AA prior to bringing the animal into the University Student Apartments. A failure to so do may result in the tenant being subject to Section 2.4 and given notice to remove the animal (providing evidence of removal within a specified time) or vacate the premises.

Medical Plaza Roommate Policy

Roommates are allowed to reside in Medical Plaza one and two-bedroom apartments. Student Apartments does not offer referrals nor assign roommates. An apartment is assigned to a primary tenant based on the waiting list policy of Section 2.7. If the primary tenant chooses to have a roommate, they must come to the Main Office with the prospective roommate. The roommate must complete an application form and be approved by Student Apartments before they move into an apartment. A primary tenant who allows a roommate to move in before they have completed this process will be subject to Section 2.4 or eviction. Roommates must be of the same gender and must fully meet student eligibility requirements.

A roommate is required to sign a Rental Agreement. A roommate is considered a co-tenant with all the rights, privileges, obligations, and responsibilities contained in this agreement. Student Apartments may evict a roommate or a primary tenant separately or together for nonpayment of rent and/or fees and/or other violations of this agreement.

Any roommate or primary tenant who chooses to vacate must give a 30-day written notice to the Main Office per Section 2.12. Roommates and primary tenants must discuss their moving plans with each other so that each is properly informed. If the primary tenant moves out the roommate must also move out or appeal in writing to the Main Office to take over the apartment as the primary tenant.

Accomodations

The University of Utah is committed to providing accommodations to all qualified students, faculty or staff with a disability. Residents or applicants for housing should make requests for accommodations in their living environment in writing at the Main Office of University Student Apartments located at 1945 East Sunnyside Avenue, SLC, UT 84108 or by email at apartments@usa.utah.edu. All information is voluntary and confidential.

Parking

Medical Plaza/Townhouses/Fort Douglas

 Parking is administered by Commuter Services (581-6415) located at 101 Annex Building. All residents of Medical Plaza, Townhouses and Fort Douglas must go to Commuter Services to purchase a parking permit. All residents are required to purchase a standard University parking permit (E, U, or A as appropriate). Residents must obtain the appropriate zone permit from the Heritage Center Front Desk by presenting a copy of their Rental Agreement. A maximum of two zone permits are permitted per resident. The zone permit is attached to the University parking permit.

A visitor permit is available for each Fort Douglas, Townhouse and Medical Plaza apartment at the Main Office. Residents are not authorized to use the visitor permit for their personal use. A fee will be assessed to the resident if the visitor permit is not returned upon move out.

Student Apartments will distribute to the Townhouse and Fort Douglas residents a Townhouse Resident hangtag for designated parking stalls. These hangtags must be used in conjunction with a University parking permit (E, U, or A as appropriate).

East and West Villages

 University Student Apartments East and West Village parking lots are restricted to apartment residents, employees, visitors, and guests. Student Apartments issues its own parking permits through the Main Office. A valid vehicle registration is necessary to obtain a permit. Because of limited parking spaces, each apartment is allowed to purchase one (1) primary “B” parking permit. Residents of the 1500 Court may purchase one (1) primary “XB” parking permit. Student Apartments will issue secondary “C” permits on a space available basis. A “B” permit may be used in any “B” or “C” lot; an “XB” permit may be used in any “XB”, “B”, or “C” lot, and a “C” permit may only be used in a “C” lot. Parking is permitted only in designated areas in accordance with posted signs. Student Apartments does not guarantee the availability of parking spaces at any particular time or location.

Guests and visitors must park in areas marked Visitor Parking. If you have guests, you may purchase a temporary permit for their use at the Main Office. This permit will be valid for a maximum of two (2) weeks from the date of purchase for parking available in “C” lots.

All Student Apartments parking permits are non-transferable and may only be used on the vehicle that it was assigned. All vehicles parked on Student Apartments property must maintain a current vehicle registration.

Commuter Services provides enforcement of parking regulations and issues parking tickets to any vehicle that is improperly parked, without a valid parking permit, or inoperable. Enforcement of parking regulations is twenty-four (24) hours per day, seven (7) days per week. All inquiries regarding parking tickets should be made to Commuter Services (581-6415).

Parking spaces have been designated for drivers with disabilities. Residents must have a Student Apartments disabled parking permit or a Student Apartments “B”, “XB”, “C” with a state-issued disabled plate or placard or University of Utah “D” permit.

Parking is not available for recreational vehicles or trailers. Motorcycles, scooters and mopeds must have the appropriate permit and park in designated motorcycle areas.

Vehicles which are inoperable or considered a health/safety hazard will be considered abandoned and will be removed from Student Apartments property at the owner’s expense. Special parking stalls are available while the car is being repaired. Contact the Maintenance Office (581-8668) to make arrangements. Vehicles which remain in one place for a period of twenty-one (21) days may be required to be moved to another space in order to verify that it is operable. Residents are responsible for keeping the parking areas clean. Waste materials such as oil, antifreeze, or brake fluids must be disposed of properly.

Lost or stolen permits will be replaced for a non-refundable charge. Lost and stolen permits are recorded and notification is given to Commuter Services. Vehicles displaying lost or stolen permits will be cited, immobilized and turned over to the Department of Public Safety (Campus Police).

Laundry Facilities

Each building in the East/West Village and each Medical Plaza tower has centrally located laundry rooms with coin operated automatic washing machines and clothes dryers. Outside clothes lines are provided in the East/West Villages. Each individual East/West Village apartment has hookups only for automatic washing machines. Tower apartments do not have individual hookups. Townhouses have both automatic washing machine and clothes dryer hookups. The following are the clothes dryer restrictions for each area:

  • North and East Court Apartments: 110-volt dryers (Note: 220-volt dryers are strictly prohibited) are permitted in the North and East Court apartments (700 Court through 1500 Court, and Building 100D), subject to the following restrictions: They must be installed in the bedroom that is closest to the washer space and properly vented. The vent must be installed and checked by our Maintenance Department. If you want to have a dryer, contact Maintenance (581-8668). They will inspect the vent or install one as needed. A dryer surcharge of $5.00 per month will be added to the resident's account.
  • Medical Plaza Towers and South Court Apartments: We prohibit all dryers (of any type) in both Medical Plaza Towers and South Court Apartments (100 Court through 600 Court, excluding Building 100D).
  • Townhouses: Dryer hookups are provided in each townhouse apartment at Medical Plaza.

Preschool and Day Care

Full Day Child Care
Student Apartments operates the Early Childhood Education Center (ECEC), a high quality child care program licensed by the State of Utah.  This education-based child care center is located in the East Community Center.  Programs are available for children ages two through eight.  ECEC gives priority registration to children of Student Apartments residents, University of Utah students, faculty and staff.  Enrollment is available to the community at large on a space-available basis.  For more information about available programs and tuition rates, call ECEC (581-8058).

Head Start Preschool Classroom
The Head Start Preschool Program is located in the West Community Center. Eligible children may utilize this program free of charge. There are two (2) half day sessions each day, Monday through Thursday. The Head Start program runs from September to June. Priority registration is given to children of Student Apartments, University of Utah students, faculty and staff. Enrollment is available to the community at large on a space-available basis. Community Centers

There are community centers located both in the West and East University Villages. The East and West Community Centers are available to residents (at no cost) for meetings and social gatherings. Tables, chairs and a full kitchen are provided. Residents must make reservations in person at least one week in advance at the Main Office during regular business hours. Groups are limited to 50 people.

Vegetable Gardens

Garden plots are available at the East and West Villages for a small fee. They are assigned each spring by the Resident Council. Residents are not allowed to dig up lawns or landscaped areas for gardens.

Visitors and Guests

Visitors may stay up to two weeks without prior written approval from Student Apartments. Longer visits require written approval from the Director or his or her designee. The maximum number of occupants cannot exceed the requirements outlined in the occupancy guidelines. Special requests will be considered on a case-by-case basis.
